Terms of Service

2.1 The Service

YAESS AI provides a Virtual Try-On platform powered by artificial intelligence. Fashion brands can upload garment images and embed a widget on their website to allow their customers to virtually try on clothing. The service is powered by third-party providers' API.

2.2 Eligibility

You must be at least 18 years old and represent a legitimate business to create a brand account on YAESS AI. By creating an account, you confirm that the information you provide is accurate.

2.3 AI Disclosure

YAESS AI uses artificial intelligence to generate virtual try-on images. You acknowledge and agree that:

• Try-on results are AI-generated and may not perfectly represent how a garment will look in real life.
• Results may vary based on photo quality, lighting, and garment type.
• AI-generated images are for visual guidance only and do not constitute a guarantee of fit, colour accuracy, or appearance.
• YAESS AI uses third-party providers to process try-on requests.

2.5 Acceptable Use

You agree not to use YAESS AI to:

• Upload images of individuals without their consent.
• Process images of minors.
• Generate or distribute misleading, defamatory, or harmful content.
• Reverse engineer, copy, or replicate the YAESS AI platform.
• Violate any applicable Kenyan law or regulation.

2.6 Brand Responsibilities

As a brand using YAESS AI, you are responsible for:

• Ensuring your customers are informed that the try-on feature uses AI.
• Obtaining appropriate consent from customers before enabling the try-on widget on your website.
• Ensuring the garment images you upload do not infringe third-party intellectual property rights.
• Complying with all applicable laws in your jurisdiction.

2.7 Intellectual Property

YAESS AI and its underlying technology remain the intellectual property of YAESS AI. Garment images uploaded by brands remain the property of the respective brands. AI-generated try-on images are generated for end-customer use and are not owned by YAESS AI.

2.8 Limitation of Liability

To the maximum extent permitted by Kenyan law, YAESS AI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to loss of profits, data, or business opportunities. Our total liability to you shall not exceed the amount you paid to YAESS AI in the three months preceding the claim.

2.9 Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service, fail to pay outstanding fees, or if we are required to do so by law. You may cancel your account at any time by contacting hello@yaess.co.ke.
